Walpack Township Committee Meeting Minutes:
May 29, 2012
The meeting was called to order at 8 p.m. by Mayor Maglio who stated this meeting was being held in compliance with the Open Public Meetings Act having been duly advertised.
Present were: Committeeman Heigis, Committeeman Pagano, and Mayor Maglio
Also in attendance: Michelle LaStarza
The minutes of the April 24, 2012 meeting were presented for approval. Committeeman Pagano made a motion to approve the minutes seconded by Committeeman Heigis and unanimously carried.
The committee reviewed the treasurer’s report and vouchers. Committeeman Heigis made a motion to approve the report and vouchers for payment seconded by Committeeman Pagano and unanimously carried. The following bills were approved for payment:

The clerk and finance officer received notification from Frankford Township Municipal Court regarding additional court sessions being held. Michelle LaStarza contacted the municipal clerk in Frankford to determine if Frankford has applied for alcohol rehab grants to cover the proposed extra court sessions. The committee would like to know how many cases are tried on behalf of Walpack and if the additional charges would be based on a user base system. Michelle will keep the committee informed as to the financial aspect of the additional fees. The clerk will search the records for an agreement regarding court services.
Michelle LaStarza informed the committee of approval from the State to adopt the budget. Mayor Maglio made a motion to adopt the budget seconded by Committeeman Pagano and unanimously carried. The public hearing was held at the previous meeting. A roll call vote followed: Ayes: Heigis, Pagano, Maglio Nays: 0 Absent: 0 Abstain: 0
Mayor Maglio read the ABC Renewal Resolution into the record. Mayor Maglio made a motion to approve the resolution seconded by Committeeman Pagano. Committeeman Heigis abstained as it is a conflict license.
WALPACK TOWNSHIP
Resolution
WHEREAS, James Heigis, a member of the Corporation, Walpack Inn Inc. is a member of the Walpack Township Committee, the issuing authority, the renewal for the year commencing July 1, 2012 must be filed with the Director of the Division of Alcoholic Beverage Control, (N.J.A.C. 13:2-4)
THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Walpack, that there is no objection to the issuance of Plenary Retail Consumption License No. 1923-33-003-003, applied for by Walpack Inn Inc. 7 Route 615, Walpack, New Jersey, by the Director, as they are not aware of any circumstance or provision of Law or Local Ordinance which would prohibit the issuance of said license.

The clerk informed the committee of the change in adopting the fireworks resolution. It seems it is necessary for the committee to adopt the resolution in order to receive approval from the state. Mayor Maglio read the following resolution into the record. Committeeman Pagano made a motion to approve the resolution seconded by Committeeman Heigis and unanimously carried.

Fireworks Display
BE IT RESOLVED by the Township Committee of the Township of Walpack that permission is granted to Celebration Fireworks 3249 Militia Road Kutztown, PA 19530 to hold a fireworks display at the Walpack Inn on Saturday, June 16, 2012 between the hours of 9 p.m. to 10 p.m. There is no rain date scheduled.

Resolution
Resolution Adopting the Sussex County, New Jersey Pre-Disaster Hazard Mitigation Plan of March 14, 2011
WHEREAS, the Township of Walpack is vulnerable to damages from hazard events which pose a threat to public health and safety and could result in property loss and economic hardship; and
WHEREAS, a multi-jurisdictional All-Hazards Pre-Disaster Hazard Mitigation Plan (the Plan) has been developed through the work of the Sussex County Hazard Mitigation Working Group, and interested parties within the Township of Walpack; and
WHEREAS, the Plan recommends hazard mitigation actions that will protect people and property affected by hazards occurring within the township of Walpack, that will reduce future public, private, community and personal costs of disaster response and recovery; and that will reinforce the Township of Walpack’s leadership in emergency preparedness efforts; and
WHEREAS, the Disaster Mitigation Act of 2000 (P.L. 106-390) (DMA 2000) and associated Federal regulations published under 44 CFR Park 201 require the Township of Walpack to formally adopt a hazard Mitigation Plan subject to the approval of the Federal Emergency Management Agency to be eligible for federal funds for hazard mitigation projects and activities; and
WHEREAS, public meetings were held to receive comment on the Plan as required by DMA 2000.
NOW, THEREFORE BE IT RESOLVED, by the Township of Walpack that:
1. The Township of Walpack hereby adopts the Sussex County, New Jersey Pre Disaster Hazard Mitigation Plan, dated March 14, 2011 as this jurisdiction’s official Hazard Mitigation Plan, and resolves to execute the actions in the plan.
2. The Township of Walpack officials identified in the Mitigation Action Plan (Sections 6) are hereby directed to implement the recommended actions assigned to them. These officials will report quarterly on their activities, accomplishments, and progress to the Township of Walpack Office of Emergency Management and the Township Committee of the Township of Walpack.
3. The Township of Walpack of Emergency Management will provide annual progress reports on the status of implementation of the Plan to the Township Committee of the Township of Walpack. The report shall be submitted to the Township by December 31 of each year.
4. The Township of Walpack Office of Emergency Management wil undertake periodic updates of the Plan in concert with the Sussex County Division of Emergency Management as indicate in the Plan Maintenance Program (Section 7) but no less frequent than every five years.
BE IT RESOLVED, the Plan is hereby adopted this 29th day of May 2012 at the meeting o f the Township Committee of the Township of
Walpack.

The committee reviewed the correspondence.
Michelle LaStarza informed the committee that the township recently underwent an IRS Audit. It was recommended that a payroll company handle payroll for the township. Michelle LaStarza obtained a proposal for services from ProPay. The committee agreed the proposed services costing $1,000 were a little costly. At the current time, payroll will remain with the chief finance officer.
Mayor Maglio read the following resolution into the record:

WHEREAS, Maureen Kaman was appointed to fill in for the position of a tenured assessor in Walpack; and
WHEREAS, Maureen Kaman filled an unexpired term set to expire on June 30, 2012; and
WHEREAS, the Walpack Township Committee wishes to appoint Maureen Kaman to her own term as tax assessor which would run from July 1, 2012 through June 30, 2016; and
NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Walpack hereby appoints Maureen Kaman to the position of tax assessor for the Township of Walpack to a term beginning July 1, 2012 through June 30, 2016.

Mayor Maglio made a motion to reappoint Maureen Kaman, Assessor, seconded by Committeeman Pagano and unanimously carried. Maureen Kaman’s term will run from July 1, 2012 through June 30, 2016.
The committee reviewed the correspondence.
There being no one in attendance and no further business to discuss, Committeeman Pagano made a motion to adjourn seconded by Committeeman Heigis. The meeting was adjourned at 8:43 p.m.
