Walpack Township Committee Meeting Minutes:

July 30, 2013



The meeting was called to order at 8 p.m. by Mayor Maglio who stated this meeting was being held in compliance with the Open Public Meeting Act having been duly advertised.


Present were: Mayor Maglio, Committeeman Heigis, and Committeewoman Wycalek


Also in attendance: Michelle LaStarza, Tom Ferry, and Erin Dunstan


Mayor Maglio made a motion to amend the agenda seconded by Committeeman Heigis. Tom Ferry and Erin Dunstan, Township Auditors, presented the Township with the 2012 audit. Tom Ferry stated the Township was in sound financial shape, but the tax collection rate has dropped from 100% to 76.02%. Because Walpack has such a small number of tax payers, one delinquency lowers the tax rate significantly. Mr. Ferry expects State aid to remain stable. Mr. Ferry stated there were no formal comments or recommendations for the audit, but advised the Mayor and Committee that in any small municipality there is a lack of internal control due to the limited amount of employees. Mr. Ferry further stated that this is true in a large number of New Jersey municipalities because of the increased costs of hiring multiple employees to segregate duties. The Committee thanked the auditors for attending the meeting.


The minutes of June 25, 2013 were presented for approval. Committeeman Heigis made a motion to approve the minutes seconded by Committeewoman Wycalek and unanimously carried.


The committee reviewed the vouchers. Committeewoman Wycalek made a motion to approve the vouchers for payment seconded by Committeeman Heigis and unanimously carried. The following bills were approved for payment:

Mayor Maglio read the following resolution:

TOWNSHIP OF WALPACK RESOLUTION

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and

WHEREAS, The Annual; Report of Audit for the year 2012 has been filed by a Registered Municipal Accountant with the Municipal Clerk as per the requirements of N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body, and

WHEREAS, the Local Finance Board of the State of New Jersey is authorized to prescribe reports pertaining to local fiscal affairs, as per R.S. 52:27BB-34, and

WHEREAS, The Local Finance Board has promulgated a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled:

Recommendations


and, 

WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled:

as evidenced by the group affidavit form of the governing body, and

WHEREAS, Such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board, and

WHEREAS, All members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and

WHEREAS, Failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52 to wit:

R.S. 52:27BB-52, “A local officer or member of a local governing body who, after a date fixed for compliance fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office”.

 

NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Walpack, hereby states that it has complied with the promulgation of Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Mayor Maglio made a motion to approve the resolution seconded by Committeeman Heigis and unanimously carried. The committee signed the Group Affidavit.


Mayor Maglio stated he sent a letter to John Eskilson regarding dispatching services. Mayor Maglio will keep the committee informed of any updates.


There being no one in attendance and no further business to discuss, Committeeman Heigis made a motion to adjourn seconded by Committeewoman Wycalek. The meeting was adjourned at 8:36 p.m.
