Walpack Township Committee Meeting Minutes:

March 29, 2016

Mayor Maglio called the meeting of Walpack Township Committee to order at 7 p.m. stating this meeting was held in compliance with the Open Public Meetings Act having been duly advertised.

Present: Committeewoman Wycalek and Mayor Maglio

Absent: Committeeman Heigis (participation via conference call as noted herein)

Also in attendance: Michelle LaStarza

Committeewoman Wycalek made a motion to approve the minutes of the meeting from January 26, 2016 seconded by Mayor Maglio. Minutes were unanimously accepted as presented.

Michelle LaStarza submitted the treasurer’s report and bills list for approval. Committeewoman Wycalek made a motion to approve the report seconded by Mayor Maglio. The following bills were approved for payment:

Mayor Maglio stated that he has been in communication with the Sussex County OEM regarding the Township Emergency Operations Plan (and Annexes), which still needs to be submitted to the State. Mayor Maglio is working with the County OEM to complete the Plan.

Michelle LaStarza introduced the new budget to the Committee for their review, discussion and comments.

Mayor Maglio signed the Firefighting Service Agreement with Sandyston Township, which was reviewed and agreed to by the Committee.

Mayor Maglio signed the agreement between Walpack Township and Sussex County Municipal Utilities Authority for Certified Recycling Professional to certify the 2016 Annual Recycling Tonnage Report, which was reviewed and agreed to by the Committee.

Mayor Maglio read the following resolution:

Walpack Township

RESOLUTION OF THE WALPACK TOWNSHIP COMMITTEE ENDORSING THE SUBMISSION OF THE 2014 RECYCLING TONNAGE GRANT APPLICATION
 

WHEREAS, the Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102, has established a recycling fund from which tonnage grants may be made to municipalities for the calendar year 2015.

WHEREAS, it is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and

WHEREAS, the New Jersey Department of Environmental Protection is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act; and

WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and

WHEREAS, a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment of this municipality to recycling and indicate the assent of the Walpack Township Committee to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and

WHEREAS, such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.

NOW, THEREFORE, BE IT RESOLVED, by the Walpack Township Committee of the Township of Walpack that the Township of Walpack hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection and that the application is properly filed; and

BE IT FURTHER RESOLVED, that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to be used solely for the purpose of recycling.

Mayor Maglio made a motion to approve the resolution, which was seconded by Committeewoman Wycalek. The resolution was unanimously approved.

Mayor Maglio stated that fire official William Flammer will be terminated due to the lapse of his State Certification. The position will be terminated because the State has now assumed jurisdiction. Mr. Flammer has been officially notified of his termination by letter from our Township Attorney and by official notification from the State.

Mayor Maglio read the following resolution appointing the new tax assessor Maureen Kaman:

As Walpack Township Tax Assessor
 

WHEREAS, Walpack Township is required to have a Municipal Tax Assessor pursuant to N.J.S.A. 40A:9-146 et seq.; and

WHEREAS, Jason Laliker, the current Tax Assessor has notified the Township of his intention to resign as the Walpack Township Tax Assessor as of March 29, 2016; and

WHEREAS, Walpack Township is in need of a Municipal Tax Assessor to replace Jason Laliker; and

WHEREAS, the current term of Jason Laliker is from July 1, 2012 through June 30, 2016; and

WHEREAS, N.J.S.A. 40A:9-148 states in relevant part “vacancies other than due to expiration of term shall be filled by appointment for the unexpired term”; and

WHEREAS, the Township has determined that Maureen Kaman is qualified to be Municipal Tax Assessor under the law and is desirous of appointing Maureen Kaman as Municipal Tax Assessor;

NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Walpack hereby appoints Maureen Kaman to the position of Walpack Township Tax Assessor at a salary of $3,200 annually, to be prorated from March 30, 2016. The initial appointment of Maureen Kaman will expire on June 30, 2016 and will then be appointed for a four-year term from July 1, 2016 to June 30, 2020, in accordance with New Jersey Statute.

Mayor Maglio read the following resolution appointing Kelly Maglio as acting clerk:

As Acting Walpack Township Clerk
 

WHEREAS, Walpack Township is required to have a Municipal Clerk pursuant to N.J.S.A. 40A:9-133 et seq.; and

WHEREAS, Betsy Cuneo resigned as the Walpack Township Municipal Clerk as of March 25, 2016; and

WHEREAS, Walpack Township is in need of a Municipal Clerk to replace Betsy Cuneo; and

WHEREAS, N.J.S.A. 40A:9-133 states in relevant part “Within 90 days of the occurrence of a vacancy in the office of municipal clerk by reason of the departure of a registered municipal clerk, the governing body may appoint a person who does not hold a registered municipal clerk certificate to serve as acting municipal clerk for a period not to exceed one year and commencing on the date of the vacancy”; and

WHEREAS, the Township is desirous of appointing Kelly Maglio as Acting Municipal Clerk for a one year term commencing on March 26, 2016 to March 25, 2017;

NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Walpack hereby appoints Kelly Maglio as Acting Municipal Clerk for a one year term from March 26, 2016 to March 25, 2017 unless extended or until such time as another individual is appointed Municipal Clerk, and which appointment may be terminated on thirty (30) days prior notice, or until her appointment as Township Clerk following completion of the appropriate course work, passage of the required examination and issuance of a registered municipal clerk certificate from the Director of the Division of Local Government Services pursuant to N.J.S.A. 40A:9-133 et seq.;

BE IT FURTHER RESOLVED, that while acting in the position of Acting Municipal Clerk, the salary of Kelly Maglio shall be $5000 annually, to be prorated from March 26, 2016.

Committeewoman Wycalek made a motion to approve motion, which was seconded via conference call by Committeeman Heigis, and subsequently approved by Committeewoman Wycalek and Committeeman Heigis; Mayor Maglio abstaining.

The committee reviewed the correspondence.

There being no one from the public in attendance and no further business to discuss, Mayor Maglio made a motion to adjourn seconded by Committeewoman Wycalek. This meeting was adjourned at 7:51 p.m.
